1. Purpose

These Terms of Service (hereinafter "ToS") define the terms and conditions under which Showduktor provides its cue sheet creation and management service, as well as the conditions under which users access and use this service.

2. Acceptance of the Terms

Access to and use of the Showduktor service implies full and complete acceptance of these ToS. By creating an account and using our services, you acknowledge that you have read, understood and accepted these terms. If you do not accept these terms, please do not use our services.

3. Description of the service

Showduktor is a SaaS (Software as a Service) platform that enables show professionals to create, manage and share technical cue sheets. The service includes several subscription plans (Free, Pro, Team) offering different levels of features and capabilities.

4. Registration and user account

• You must create an account to use Showduktor
• The information provided must be accurate and up to date
• You are responsible for the confidentiality of your credentials
• You must be at least 18 years old to create an account
• An account is personal and may not be shared
• We reserve the right to suspend or delete any account in case of violation of the ToS

5. Subscriptions and pricing

• Free plan: Free, limited basic features
• Pro plan: $9.99/month, advanced features
• Team plan: $29/month, unlimited team collaboration
• Prices are shown in USD including all taxes
• Subscriptions are automatically renewed
• You can cancel your subscription at any time
• No refunds are issued for unused periods
• We reserve the right to modify our pricing with 30 days' notice

6. Use of the service

• You agree to use the service lawfully and in compliance with these terms
• Sharing illegal, offensive or defamatory content is prohibited
• Attempting to hack, disrupt or damage the service is prohibited
• Using the service to send spam or unsolicited content is prohibited
• You are responsible for the content you create and share
• We reserve the right to remove any content that violates these rules

7. Intellectual property

Showduktor and all its elements (logo, design, code, features) are the exclusive property of their creators and are protected by intellectual property laws. You retain all rights to the content you create (your cue sheets). By using our service, you grant us a limited license to host and display your content.

8. Personal data

Your personal data is processed in accordance with our Privacy Policy. We only collect data necessary for the operation of the service and are committed to protecting it. You have the right to access, rectify and delete your data.

9. Liability

• The service is provided "as is" without warranty of any kind
• We strive to ensure maximum availability but do not guarantee uninterrupted service
• We are not liable for indirect damages resulting from the use of the service
• You are responsible for backing up your data
• Our liability is limited to the amount paid for your subscription

10. Termination

You may terminate your account at any time from the settings. We may terminate your account in case of violation of the ToS, with or without notice depending on the severity. Upon termination, your data will be deleted after a 30-day grace period.

11. Changes to the Terms

We reserve the right to modify these ToS at any time. Changes will be notified by email and/or on the website. Continued use of the service after modification constitutes your acceptance of the new ToS.

12. Governing law and jurisdiction

These ToS are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the French courts.
